Object of the Contract
This contract defines the terms of services of analysis and audits performed by QUALACS at the request of the client.
The acceptance of any offer from QUALACS implies accession to the present general terms and conditions.
Commands
Only will be taken into account the orders provided by the customer in written form (contract, letter on letterhead, use of standard forms provided by the QUALACS) by fax or mail.
Phone orders will systematically subject to written confirmation by the customer.
Sending samples is equivalent to a command and implies acceptance of terms and conditions of QUALACS.
Price
The prices are charged in force in the rate to date of the order or in the case of contracts specific to those who have communicated to the client in the quotation accepted by letter.
Tariff specific conditions may be applied under contract by annual monitoring.

Withdrawals
The samples may be made by our supplied service under defined conditions written in the contract.
Obligation of the Client
The client must take all measures to ensure the good services can be achieved in the best conditions and without risk to personnel QUALACS. In particular the client must ensure possible access to premises and information to the representative of QUALACS as well as the security and safety of conditions of work of sites and installations.
The client must also inform QUALACS of any type of risk inherent in the samples provided to the laboratory for the realization of its services analysis.
In the case of sensory testing of products not yet implemented on the market, the customer is required to provide a safety certificate to QUALACS.
The client must provide in time compatible with due acknowledgement of all information, instructions and documents necessary for the proper production of services requested.
The samples submitted to the laboratory for analysis are not returned and destroyed after analysis.
Analytical protocols
The methods of analysis provided to the customer are shown on the estimate indication.
These methods may vary according to the matrices or specific regulatory.
We use standardized methods (ISO, EN, NF) accredited or validated internally in the measurement of the existence of such methods.
Time
The time delays analysis are for proposed information only and does not constitute a firm commitment of QUALACS.
Notwithstanding this reservation, QUALACS apply as far as possible to meet the deadlines specified to the customer.
Sending of Reports
Analytical reports are sent by mail or email upon completion of the analysis to the attention of persons designated.
Reports issued in response to the analysis carried out on samples only concern them and cannot relate to the lot on which they have been collected.
Privacy
QUALACS ensures the confidentiality of the information sent to only interlocutors cites.
Warning
QUALACS undertakes to notify the client of the results at risk health of their knowledge. To do this, QUALACS sends the client an email alert security as soon as the research of Listeria and Salmonella is carried out (or any other germ on request).
Advice and Assistance
If the analysis reveals non-compliances with the regulation of the product, QUALACS join a letter customized for corrective action to be carried out.

Client’s responsibility
Implementing corrective actions and possible information to the relevant health authorities are under the client’s responsibility.
Rates
It includes all of the services listed in the quotation.
Any requested additional product analysis or any new analysis requested in addition will be a quote complementary.
The signed contract must be submitted by mail or fax to the above address or hands own.
Tariff changes are defined each calendar year beginning.
The invoices are transmitted with reports analysis.
Payment terms
Payment on our account ING 363 - 0765806-31 without discount within 30 days.
Delay or default in payment
Failure to pay by this date may result, after sending a formal notice, a late penalty interest at the rate of 10% per month of delay on the VAT amount.
The payment can be delayed under any pretext whatsoever, same issue.
QUALACS may choose to prosecute with any Court of competent jurisdiction for the recovery of the due amount. The possible legal costs are at the customer’s expense.
Services
QUALACS is unable to ensure any kind of analysis of food and non-food products in France and Belgium.
Contact us by phone call or via our Contact page, a quote will be sent to you within 48 hours. It must be returned to us signed for confirmation. No delivery will be made without prior written agreement.
Subcontract
QUALACS subcontracting may delegate all or part of service to a subcontractor.
The customer authorizes QUALACS to disclose the subcontractor any information necessary for the execution of the service.
The customer will be informed of the possible subcontracting all or part of the requested analysis.
Guarantees and Responsibilities
QUALACS implements all the technical means at its disposal and its know-how for their services to be performed under best conditions and achieve a most reliable results. However QUALACS cannot guarantee the absolute accuracy of reports and interpretations.
QUALACS cannot not be held responsible for the consequences of the use of reports in commitment or non-commitment of action by the client.
The reports are intended to the customer sole use who is the sole judge of the validity of the information they contain and solely responsible for the use he wishes to achieve.
QUALACS cannot be responsible for any defect in the realization of its service in case of force majeure including fires, failures of equipment, natural disasters, etc.
Applicable law / competent courts
Any dispute relating to the provision of our laboratory will be judged by the Tribunal of Commerce (Liège). The applicable law is the Belgian law.
Suspension or termination of services
QUALACS has the right to immediately suspend its services or to terminate for breach by the customer of any of its obligations or no return to normal suspension of payment within 10 days following notification by QUALACS customer.
